Code of Practice

To clearly inform all prospective students (to include, trainees and clients) in writing of the services provided by me, with particular reference to my Trainers qualifications, and costs relating to the time required to reach the standard of the Driving Standards Agency test of driving competence, venue, duration and contents in relation to the ADI examination structure and make adequate arrangements necessary to acquaint students with my Terms and Conditions and my complaints procedures.

To avoid improper language, suggestions or physical contact with students.

To take all reasonable care, skill and diligence in instructing students in all aspects of traffic, driver education, taking account of individual needs and ensuring the safety of students and to gain entrance onto the Register of Approved Driving Instructors.

Not to discuss information disclosed by any students during training, with any other party, except where under obligation by law; and not to discuss the students progress or driving standard with any other party, except for normal consultation within the training session.

To maintain proper standards of personal hygiene and dress.

To ensure any vehicle driven or used for training is maintained in good mechanical order and condition, is properly insured, taxed, and where appropriate, certified as roadworthy; and that all reasonable care is taken to keep it clean and tidy.

To ensure that professional driving tuition is carried out only within the terms of the law; with particular reference to driver licensing and provision of a professional service

Responsibility

I cannot be held responsible for postponements of lessons by me, due to illness or mechanical breakdown, nor for driving tests postponed by the Driving Standards Agency

Personal Conduct (both Trainer and Instructors)

Each party must treat all information received from the other party as confidential and must not discuss this information with anyone not entitled to receive it.

You will at all times behave in a professional manner towards clients and each other.

Clients will be treated with respect and consideration

You will try to avoid physical contact with the client except in an emergency or in the normal course of greeting

Whilst reserving the right to decide against giving tuition, you will not act in any way, which contravenes legislation on discrimination

Data Protection

Your data will be held in strict confidence in accordance with the acceptable data protection laws.

Business Dealings

You will safeguard and account for monies paid in advance by the client in respect of driving lessons, test fees or for any other purpose and will make details available to the client on request.

Ensure that professional ADI training complies with the current legislation particularly in respect of business premises and practices, staff and public liability.  Abide by the code of practice and other requirements for the provision of a professional service.

Training

Terms & Conditions

The following terms and conditions represent the basis upon which Tony Byiast offers training.  The provision of training is subject to your acceptance of these terms and conditions.

Driving Licence   

All drivers must produce your FULL, CURRENT AND VALID DRIVING licence: both the Plastic and Counterpart, on your first training session.

Deposits & Cancellations

All training cancelled within 48hrs notice will require the full training to be paid in full.

Training Location

Training will always start and finish at the same location: either Braintree or Chelmsford, unless other arrangements are made in advance and confirmed in writing.

Time Keeping

In the event of me arriving late for a training session, because of difficulties that may be caused by circumstances beyond my control, you will receive back the full amount of training paid for, or a credit for any lost time.

Training Vehicle

Part Two training is normally done in your vehicle: this allows practice between lessons; if you require the use of my vehicle I will require notice of 48hrs.  Vehicles provided by me will incur an extra hourly charge.

Part Three training is normally done in my vehicle: This allows two Trainees in the car at the same time.

You will; on or before the first lesson provide clients with a written copy of the terms of business to include:

Legal Identity of the school/instructor with full address and telephone number at which the instructor or representative can be contacted.

Annex B.

Price and duration of lessons

Annex C.

Price and conditions of use of a driving school car for practical driving test.

Annex D.

Terms under which cancellation by either party may take place.

You should check a client’s entitlement to drive the vehicle and their ability to read a number plate at the statutory distance for the first lesson. When presenting a client for the practical driving test you should ensure that the client has all the necessary documentation to enable the client to take the test and that the vehicle is roadworthy.    

You will advise clients when to apply for their theory and practical driving test, taking account of local waiting times and forecast of clients’ potential for achieving driving test pass standard.  You will not cancel or re-arrange a driving test without the client’s agreement.  In the event of the instructor’s decision to withhold the use of the school car for the driving test, sufficient notice should be given to the client to avoid loss of the DSA test fee.

You should at all times, to the best of there ability, endeavour to teach the client correct driving skills according to DSA’s recommended syllabus.

These conditions do not affect any protection a client has under consumer legislation

Annex B.

Price and Duration of Lessons

The price and duration of lessons will depend upon your individual requirements and needs.

I will endeavour to keep my prices competitive, however the services I offer are all relative to the cost of running my business and the level of service you require, this may cause me to adjust my prices accordingly, you will receive notice prior to any changes in pricing.

Generally:

Part Two training.

One to One in your car, duration of two hours.

Vehicles provided by me will incur an extra hourly charge.

Part Three Training.

One to One or Two to One training normally in my car

Duration: 

One to One:           Two hours.

Two to One:          Four or Eight hours with comfort/coffee breaks and half hour lunch break.

 

Cheques not honoured by your bank will result in an administration charge of £35.00.

Annex C.

The Price and Conditions for Use of a Driving School Car for Practical Driving Test.

Road Safety

I reserve the right to withdraw my car for tests without notice should the student prove not to be up to test standard.

The cost of hiring my car for your practical test will be the same hourly rate as a normal lesson

If you require the use of my car for your test I require 4 weeks notice

The Terms under which Cancellation by Either Party may Take Place

Payments

All payments are made at the end of each and every lesson, or in advance if you choose the intensive accommodation option.  If you pay by cheque, please ensure that it is made payable to Tony Byiast.  Cheques not honoured by your bank will result in an administration charge of £35.00

Deposits & Cancellations (Intensive courses)

A deposit of 50% of the total cost of training is required to reserve training dates, including any accommodation arranged by me.  This deposit is forfeit for all training cancelled with less that 21 clear working days notice.

Deposits & Cancellations (Daily Course)

All training cancelled within 48hrs notice will require the full training to be paid in full.

Timekeeping

In the event of me arriving late for a training session, because of difficulties that may be caused by circumstances beyond my control, you will receive back the full amount of training paid for, or a credit for any lost time.

Annex E.

Procedures for Complaints

In the first instance inform me personally for the reason of your complaint.  Please give the reason for your complaint and the solution you are looking for.

Step Two

If you have followed the procedure in step one and are not satisfied with the response, you may write to the Chief Executive at the DSA.

Step Three

If you have followed steps one and two and are still not satisfied, you may also get advice from your Member of Parliament (MP)

Note:

It is in both our interests to solve this matter internally.

Annex F.

Necessary Documentation to Enable the Client to take the Test

Any one taking the DSA Driving test, both Theory and Practical, will need to provide the following documents for inspection prior to the test:

A photocard plastic licence and the paper counterpart.

or

If you do not have a new photocard licence you will need to produce your old paper style licence and photographic proof of identity

It is advisable to take the letter of confirmation of test date and timings

If you are using a Logbook take that as well

For your practical test take your Theory Pass Certificate

Eyesight test:

Learner Driver

You must be able to read a motorcar number plate at a distance of 20.5m in good daylight, with the help of glasses or contact lenses if worn.

ADI  

You must be able to read a motorcar number plate at a distance of 27.5m (90ft), where the letters and numbers are 79.4mm tall in good daylight, with the help of glasses or contact lenses if worn.
